1. Acceptance of Terms

By accessing and using PeanutsProperty.co.nz ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. Platform Purpose

PeanutsProperty.co.nz is a property advertising platform that allows users to list properties for sale. We are not real estate agents and do not provide real estate services. We simply provide a platform for property listings.

3. User Responsibilities

Users listing properties on the Platform agree to:

• Provide accurate and truthful information about their property
• Comply with all applicable laws, including the Fair Trading Act 1986
• Have the legal right to list and sell the property
• Not post false, misleading, or deceptive content
• Not engage in any illegal or fraudulent activities
• Maintain professional conduct with potential buyers

4. Listing Fees

Standard property listings are charged at the price displayed on the Platform at the time of purchase. The current standard listing fee is $49.95 per property, with discounted rates available for qualifying bulk listings. Approved VIP Members may create listings in accordance with the terms of their active VIP Membership.

Bulk Listings — A discount fee structure is applied per batch of listings completed at one time — batch size is unlimited. (i.e. you can list as many properties as you want in any one batch at one time.) Once you complete your batch listing and finalise payment — your listings go live and our system resets to normal price.

5. Licensed Agents

Real estate agents using the Platform must provide a valid licence number and are responsible for ensuring that their use of the Platform complies with their professional and legal obligations, including any obligations to their clients regarding advertising costs or fees.

6. Limitation of Liability

PeanutsProperty.co.nz is not liable for:

• Any losses or damages arising from property transactions
• The accuracy or completeness of listings posted by users
• Any disputes between buyers and sellers
• Any failure to sell a property
• Any issues arising from user interactions

7. Content Removal

We reserve the right to remove any listing or content that violates these terms, is illegal, offensive, or otherwise deemed inappropriate, without prior notice and without refund.

8. Intellectual Property

All content on the Platform, including logos, design, and text, is the property of PeanutsProperty.co.nz and is protected by copyright laws. Users retain ownership of their listing content but grant us a license to display it on the Platform.

By submitting a listing to PeanutsProperty.co.nz, the user grants Peanuts Property permission to display, promote, and market the listing, including associated images and property information, across the Peanuts Property website and associated social media channels for promotional purposes.

9. VIP Membership Terms

Peanuts VIP Membership is available exclusively to approved licensed real estate agents.

VIP Membership provides unlimited property listings while the membership remains active and in good standing. Existing property listings will remain published until sold or otherwise removed by the member, even if the membership later expires or is cancelled. However, new property listings cannot be created unless the membership is active.

VIP Membership is issued to an individual licensed real estate agent and is intended for that member's sole use. It may not be shared, transferred, assigned or used by any other person, agency, office, business, team or organisation.

Membership fees are payable in accordance with the selected payment plan. Where applicable, recurring payments are processed securely through Stripe. Members may manage their payment method, billing details and subscription through the Membership section of their Dashboard.

PeanutsProperty.co.nz reserves the right to suspend, cancel or revoke a VIP Membership where it reasonably believes the membership has been misused, shared, transferred, assigned, obtained fraudulently, or used in breach of these Terms.

Cancellation of a VIP Membership does not automatically entitle the member to a refund of membership fees or instalments already paid. Any amounts due or payable will be handled in accordance with the member's selected payment plan and applicable New Zealand law.

VIP Membership pricing, payment plans and benefits may be amended for future memberships or renewals. Any changes will not affect payments already made under an active membership unless agreed by the member.

PeanutsProperty.co.nz reserves the right to approve or decline any VIP Membership application at its sole discretion.

10. Indemnification

Users agree to indemnify and hold harmless PeanutsProperty.co.nz, its owners, employees, and affiliates from any claims, damages, or expenses arising from their use of the Platform or violation of these terms.

11. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
